THUNDER BAY — Two men have been found guilty of sexual assault in relation to a 2024 incident.
Justice Danial Newton read out a summary of events while delivering his judgment on Monday in a Thunder Bay courtroom.
On April 10, 2024, the victim was visiting relatives in Armstrong when she was assisted by another person in the house to a bedroom where she fell asleep from intoxication.
The first offender was then seen in the same room as the victim by another person in the house. At this time, the victim’s lower body could not be seen. However, the man’s pants were halfway down.
Another person in the house recalled seeing the second man touching the victim over her clothes while in the bedroom.
When the victim left the house, she did not remember what had happened. Her pants were on, but her underwear was around one ankle.
Later, the victim and a family member approached police and said there had been a sexual assault.
Police then took the victim to the hospital, where physical evidence of sexual assault was discovered.
A forensics expert could not exclude one of the men based on DNA.
The two men were charged with assault on the day of the incident.
Both of the accused were found guilty of sexual assault and one was also found guilty of failing to comply with probation.
The two men will return to court at a later date for sentencing submissions.
